Special measures for adoption

Special measures in adoption process is a status applied where:

  • Appropriate prospective adoptive parents enrolled in the register kept by the Ministry of justice for adoption have not been found for specific child
  • The Council of international adoption /CIA/ cannot select appropriate prospective adoptive parents among the persons enrolled in the Register
  • The parents who had received a referral for particular child refused the adoption of a child with health problem, special needs or older than seven years old

Types of special measures:

  • The Ministry of justice /MOJ/ issues every month between the Day 25 and the Day 30 of the relevant month a list, containing information that can be accessed by accredited bodies /AB/ licensed in Bulgaria only. This list is containing of :
    1. The profiles of the children for whom the CIA has ascertained the occurrence of the circumstances referred to above during the previous month;
    2. The profiles of the children which had been published during the previous months for whom adoptive parents are sought.
  • Providing information and detailed data on specific child from the list upon request by the AB The information is provided upon a letter and a portable memory device

How the information is passed to the Accredited Body outside Bulgaria, which partners with “Our family”:

  • Within 2 months, the AB which had received the profile’s information /Our family too/ is obliged to take all efforts in order to examine the specifics of the children, on the base of the information provided by the MOJ and/or through gathering additional information – taking photos and/or video, questionnaires, consults, etc. Medical test and / or consultations on a specific case with specialists can only take place after written and motivated request and preliminary consent by the MOJ and the competent Authority.
  • The AB licensed in Bulgaria provides the Accredited Body outside Bulgaria with received and gathered information for each child and this information must be used only for the purpose of the adoption of the child and in compliance with the personal data protection rules

Deadline for submitting an application

  • Within 2 months from receiving the profile’s information by MOJ, the AB must submit an application for adoption of the specific child with special needs signed by prospective adoptive parents or to hand back the information to MOJ.

How to apply for adoption where special measures have been applied

If the prospective adoptive parents have not been enrolled in the Register of the prospective adoptive parents with habitual residence outside of Bulgaria, kept by MOJ, they have to submit:

  • Application for adoption stating the three names, date of birth, main diagnoses and conditions of the child and the profile number in the list
  • Power of attorney issued in favor of “Our family”
  • An agreement with “Our family”
  • A document showing that the prospective adoptive parents have commenced a home study process with a view to adopting the particular child issued by the competent authority who carries out the said process in the country of the parent

The parents are allowed to present either a photocopy or an original. The above said documents may be presented notarized or without notarization, apostilled or not

The application shall be examined immediately by the CIA, in case of any errors, the MOJ shall notify the AB and instructed them to revise the documentation within 1 month period

  • Application for adoption stating the three names, date of birth, main diagnoses and conditions of the child and the profile number in the list – in original, notarized and apostilled /where applicable/
  • Approval for adoption accordingly the legislation of the State of habitual residence of the adoptive parent- in original, notarized and apostilled /where applicable/
  • Certificate, issued by a competent authority, attesting that the adoptive parent is not deprived of parental rights -in original, notarized and apostilled /where applicable/
  • Completed home study report- in original, notarized and apostilled /where applicable/
  • Medical certificate issued by a doctor, stating the health status of the adoptive parent which contains an assessment of the physical and mental health of the person based on past and current illnesses; the document also contains data on the presence / absence of chronic diseases, contagious venereal diseases, AIDS, tuberculosis and other life-threatening diseases and should be issued not earlier than one year from the filing of the application – in original, notarized, apostilled /where applicable
  • Criminal clearances both local and FBI – in original, notarized and apostilled /where applicable/
  • Copy of the passport – signed by the adoptive parent
  • Marriage certificate – in cases of adoption by spouses – in original, notarized, apostilled /where applicable/
  • Power of attorney issued in favor of “Our family” in original, notarized, apostilled /where applicable/
  • An agreement with “Our family”

If all the documents have not been presented but the home study report corresponding to the child’s profile has been presented within the 6 months period, the adoptive parent may be given an additional period of up to three months.

If the papers are not submitted within the deadline, the procedure is terminated and the child’s profile is re-published in the list

On the ground of the submitted documents the adoptive parents shall be entered in the register of the adoptive parents who have their habitual residence outside. The entry shall be made on the date on which the last required document was received at the Ministry of Justice and in accordance with the order of receipt.

If the prospective adoptive parents have been already enrolled in the Register of prospective adoptive parents with habitual residence outside Bulgaria kept by MOJ, they have to file:

  • Application for adoption stating the three names, date of birth, main diagnoses and conditions of the child and the profile number in the list
  • Recommendation by the specialists working with the adoptive parents regarding their ability to meet the needs of the particular child.

After approval by MOJ, the application and the recommendation must be filed in original, notarized and apostilled within 6 months period, together with update home study report and approval for adoption/ where the characteristics of the child don’t meet the approval for adoption/

Receiving an international adoption referral

After filing all the papers said above, a report on the adoptive parents and a report of the child are presented to the CIA

When the CIA takes a resolution to refer the child to be adopted by the applicants, the CIA must take into consideration the facts the circumstance that for the child special measures have been taken
